Disolución matrimonial y disputa de bienes: El caso de la propiedad de la tierra

Marital dissolution has been a legal process subject to reforms in Ecuador, especially when it involves disputes over real estate. This research aimed to analyze the relationship between divorce and land ownership in the community of Carpuela, Cantón Ibarra, identifying the legal and social challenges that arise in these cases. A mixed methodological approach was employed, combining qualitative and quantitative techniques. Interviews with key informants were conducted, and questionnaires were applied to understand the perceptions of those involved. Additionally, the current regulations on land allocation in divorce proceedings were examined. The results showed that a lack of information and bureaucratic obstacles hindered the regularization of land tenure, creating uncertainty and conflicts between the parties. It was found that land ownership not only represented an economic asset but also influenced family and social stability. It was concluded that land disputes in divorce cases require more equitable regulations and more efficient resolution mechanisms. Strengthening institutional intervention and improving the dissemination of legal information were recommended to prevent conflicts and ensure legal security for those affected.
