Food Law: An Analysis of Its Evolution and Regulations in Ecuador

Among the fundamental human rights is the right to maintenance. In Ecuador, this right has evolved from the nineteenth century to the present. A regulation that affects the development and protection of this right concerning children and adolescents is Resolution No. 04-2018 of the National Court of Justice. The objective of this paper is to analyze the impact of Resolution 04-2018 of the National Court of Justice on due process in Ecuador, from a legal and constitutional perspective. To this end, the evolution of the right to maintenance and its relationship with due process were taken into account. Methods of legislative and jurisprudential analysis were used to evaluate the effectiveness of the current regulations. It was considered that there is interaction with other rights, such as the right to defense. Resolution No. 04-2018 requires constant regulatory review and adaptation to address changing realities and ensure equitable justice for all involved.
