Challenges to the administration of justice arising from unilateral terminations of public works contracts.

In the context of public procurement, it is identified, in an argued and critical manner, how the current judicial practice in Ecuador, when resolving disputes arising from the unilateral termination of public works contracts, undermines the equality of conditions for the parties involved and the efficiency in resolving such conflicts. This represents a challenge that the judicial system must address and resolve. Therefore, through descriptive research and the application of a qualitative methodological approach, utilizing scientific methods such as exegetical, historical-logical, and inductive analysis, an examination of Unilateral Termination Resolutions is conducted. Actions are identified to proactively respond to conflict resolution through judicial means, presenting argued and critical proposals as a way to resolve such disputes involving public administration. It is proposed that, in all cases of disputes within the realm of public procurement, the first option for conflict resolution should be alternative measures such as arbitration and mediation, with their resulting agreement being a prerequisite for filing claims before the administrative contentious courts. These courts must ensure compliance with constitutional rights at all levels and with all remedies available.
