Lack of administrative responses: detriment to efficiency and citizens' rights

The issue arising from the contradiction in Administrative Silence was analyzed. On the one hand, Positive Administrative Silence was interpreted as the tacit approval of a citizen's request when no response was given within the time frame established by law. On the other hand, Negative Administrative Silence was considered as the implicit rejection of the request if no response was received within the legally determined period. In this context, the objective was to propose a reform to the Organic Administrative Code to improve the resolution of citizens' requests. This reform should ensure respect for the rights to petition, efficiency, and good public administration. To support this proposal, doctrine, jurisprudence, and scientific articles were used, along with quantitative and qualitative methods through surveys conducted with Ecuadorian citizens. These surveys reflected public opinion regarding the performance of public administration. The results showed that Administrative Silence represents a fictitious response in administrative management, which confirmed the existence of an inadequate response from public entities toward citizens. In conclusion, the need for a reform was determined to ensure proper and efficient performance by all public sector institutions.
