Child support reduction and the best interests of the child: Analysis of the regulations

Child support is a legal mechanism designed to guarantee the support of people in situations of economic dependency, especially minors. However, in certain cases, those obligated to pay support may request a reduction in the support due to changes in their economic circumstances or the needs of the beneficiary. This study analyzes the legal basis for reducing child support, as well as its impact on the protection of the fundamental rights of the parties involved. A qualitative method with a documentary design, an exegetic method, and an observation guide were used. The conclusion was that judicial decisions must prioritize the well-being and comprehensive development of children, in addition to balancing the financial needs of parents with the protection of their children's rights. Legislative reforms are recommended, as well as the use of mediation as an alternative conflict resolution mechanism to ensure justice in family relationships.
