Urban sustainability and water resources: An analysis of rights violations in the Monjas River basin

This study analyzes the violation of environmental and social rights in the Monjas river basin (Quito, Ecuador), examining Constitutional Court Ruling No. 2167-21-EP/22, which holds the Decentralized Autonomous Government (GAD DMQ) responsible for failing to comply with regulations to mitigate river pollution. The case is contrasted with international (Whanganui, Atrato rivers) and national (Vilcabamba river) examples, showing shortcomings in constitutional enforcement and in comprehensive reparation processes. The research employs a mixed approach (qualitative-quantitative), with documentary review, analysis of sentences, technical visits and evaluation of water quality indicators (SDG 6.3). The results reveal severe anthropogenic pollution, water erosion and lack of wastewater treatment (only 3.5% treated in Quito). A decentralized public policy is proposed, based on green-blue infrastructure, remediation plans and citizen co-responsibility. It concludes that, despite the progressive legal framework (rights of nature in the Ecuadorian Constitution), implementation fails due to lack of funding, institutional coordination and social participation. It recommends strengthening regulations, academic monitoring and environmental education to achieve the Sustainable Development Goals (SDGs).
