The Constitutional Court's jurisprudential line on gynecological-obstetric violence in Ecuador

The general objective of this research was to analyze the recognition of gynecological-obstetric violence in Ecuador through the provisions of the Constitutional Court in order to determine the current jurisprudential line surrounding this type of violence. Among the main results obtained, it is highlighted that in Ecuador, violence against women is recognized in different normative bodies, including the Comprehensive Organic Criminal Code; however, when specifically investigating gynecological-obstetric violence, it was evident that it is not established within the COIP. Hence the importance of Sentence No. 904-12-JP/19 issued by the Constitutional Court, through which parameters were established to identify this type of violence and even comprehensive reparation measures aimed not only at repairing the harm caused to the victims but also at preventing the public and private health systems from continuing to perpetrate practices that violate the rights of women in need of gynecological-obstetric care. The methods used from a theoretical point of view were: dialectical, analytical-synthetic, inductive-deductive, as well as legal exegetic, and the comparative law method.
