The right to die with dignity in Ecuador: legal, ethical, and social analysis of constitutional ruling 67-23-IN/24

The purpose of this research was to analyze the legal, ethical, and social impact of Constitutional Ruling 67-23-IN/24 in Ecuador, which established the conditional constitutionality of euthanasia in cases of serious and incurable illnesses. The study examined the relationship between the right to die with dignity, personal autonomy, and current criminal legislation, considering the arguments presented by the Constitutional Court in its decision. A qualitative approach was used, based on the analysis of legal documents, legal doctrine, and jurisprudence. Inductive and deductive methods were applied to interpret the scope of the constitutional decision and its alignment with human rights principles. Additionally, a comparative literature review on euthanasia regulations in different countries was conducted, identifying similarities and differences with the Ecuadorian case. The results indicated that the ruling represents progress in guaranteeing the right to self-determination and relief from suffering in extreme cases, while also establishing clear parameters for the partial decriminalization of euthanasia. However, the need for a regulatory framework to govern its application was evident, ensuring transparency and ethical-medical oversight. It was concluded that the Court’s decision reflects an evolution in the recognition of individual rights, although normative and social challenges remain in its implementation. The development of complementary legislation is recommended to ensure safe and regulated access to euthanasia in Ecuador.
