The concept of negligent homicide presents an ongoing challenge within Ecuadorian criminal law, as it requires distinguishing between intentional acts and those arising from negligence or imprudence. This offense, as defined in the Organic Comprehensive Criminal Code (COIP), aims to balance the protection of life as a legal right with proportional sentencing. Doctrinal debates revolve around the interpretation of eventual intent and conscious negligence, complicating the consistent application of the law. Moreover, comparative jurisprudence and principles of culpability and proportionality are crucial for sound judicial interpretation. The analysis of relevant cases highlights the need to strengthen legal professionals’ training in evidentiary assessment and causality. Likewise, updating procedural and normative frameworks is essential to ensure fair and proportional penalties. Thus, the legal study of negligent homicide extends beyond punishment, encompassing ethical, social, and legal dimensions that contribute to building a more just and rational criminal justice system.
