The impact of international arbitration on the evolution of the Ecuadorian legal framework after the 2024 referendum.

International arbitration has emerged as a crucial mechanism for dispute resolution in a global context where state sovereignty and transnational legal cooperation intertwine. Following the April 2024 referendum, the national legal framework underwent a series of normative reinterpretations that sparked debate regarding the legitimacy, effectiveness, and scope of arbitration vis-à-vis domestic law. In this context, international arbitration functions not only as an alternative justice mechanism but also as an institutional stabilizer capable of balancing public and private interests in disputes of significant economic and political impact. Its relevance lies in its ability to uphold principles of fairness and legal certainty, thereby strengthening confidence in foreign investment and multilateral cooperation. Nevertheless, the challenges arising from its interaction with post-referendum constitutional reforms demand a re-evaluation of the State’s role in enforcing and recognizing arbitral awards. Ultimately, international arbitration consolidates itself as a cornerstone of contemporary legal governance, provided that a balance is maintained between sovereign autonomy and international obligations—essential components for reinforcing the rule of law in the post-referendum context.
