Normative and legal analysis of medical brigades in Ecuador: a case study

The regulation of medical brigades in Ecuador faces regulatory challenges that affect their operation and supervision. The objective of this study was to analyze the current legal framework and its implications for the operation of these initiatives, identifying possible regulatory gaps and their impact on the quality of health services. A qualitative approach was used with a single case study design, primarily applying document review and structured observation to evaluate the regulatory compliance of a specific medical brigade. The results revealed multiple violations of the Organic Health Law, including the lack of operating permits, improper handling of medical waste, and the distribution of medications without technical specifications or with expired expiration dates. Additionally, contradictions between Ministerial Agreement 032-2020 and Ministerial Agreement 343 were identified, generating uncertainty about the requirements for authorization and supervision of these brigades. The absence of specific regulations for temporary medical brigades exacerbates the problem, making it difficult to enforce sanctions and protect patients' rights. It is concluded that updating the current regulations is essential to clearly define the operational requirements, ensure rigorous control of these initiatives, and strengthen health supervision mechanisms. Moreover, the importance of detailed technical reports supporting regulatory decision-making is emphasized. The study contributes to the debate on the need to harmonize the legal framework to ensure the safety of patients and professionals.
