Constitutional justice as a guarantee of rights in the ecuadorian state model

The research aimed to analyze the role of Constitutional Justice as an effective Guarantee of Rights within the Ecuadorian State Model, addressing its importance and practical functionality. To this end, theoretical methods such as the Analytical-synthetic, Inductive-deductive, and Historical-logical were employed, complemented by an empirical approach through semi-structured interviews conducted with key informants in the legal field. The results obtained indicated that, although the Ecuadorian regulatory framework established various control and oversight mechanisms, the practical effectiveness of Constitutional Justice was hindered by the interference of the Executive Power in the other State Functions. This influence limited the independence of judicial and oversight bodies, affecting institutional transparency and compromising the guaranteeing nature of the State of Rights and Justice model. It was concluded that there is an urgent need to strengthen the autonomy of the State Functions and to guarantee the full application of constitutional review, as this is the means to preserve democracy and the full validity of rights in the Ecuadorian context.
