The principle of the best interests of the child in the adoption process in Ecuador

Here is an article about the constitutional and legal relevance of the principle of best interests of the child and how, despite this relevance, it is still common, at least in the Ecuadorian procedural context, for its violation to occur, especially in the field of adoption processes. To this end, the general objective is: Demonstrate in a legally argued manner, how the gaps and regulatory ambiguities present in the processing of adoption processes in Ecuador, using the study of specific cases as a sample, violate the principle of best interests of the child and affect their complete well-being when it should constitute a procedural priority. Then, through a qualitative approach and the application of scientific methods such as: bibliographic review, analytical-synthetic, exegetical and inductive. Concluding that, a specific list of corrections is required that range from the legal system to the professional training of the legal operators of the processes that involve the interests of children and their well-being, already provided here in the last subtitle, aimed at truly prioritizing their well-being.
