The voluntary inventory procedure in the marital property regime under ecuadorian procedural law

The voluntary procedure is a non-contentious legal mechanism that allows citizens to request judicial intervention to provide legality and certainty to certain actions without opposition between the parties. In Ecuador, this procedure is regulated in the Organic General Code of Processes (COGEP) and covers various matters, including the inventory in the conjugal society. This study aimed to analyze the regulations applicable to the voluntary procedure in the context of inventory of assets within the conjugal society, evaluating its impact on legal security and equity in asset distribution. A qualitative approach with an analytical design based on documentary analysis of relevant legislation, doctrine, and jurisprudence was employed. The results show that the voluntary procedure allows formalizing legal situations without conflict, ensuring speed and security in its processing. In particular, the inventory in the conjugal society is an essential requirement for its liquidation and partition, ensuring equitable distribution of common assets according to established legal principles. However, in case of opposition from one of the parties, the procedure ceases to be voluntary and becomes contentious, requiring substantiation through a summary procedure. It is concluded that the correct application of the voluntary procedure and inventory in the conjugal society contributes to transparency and justice in the dissolution of family assets, strengthening the legal security of the intervening parties and facilitating the equitable administration of assets acquired in marriage or de facto union.
