Admissibility of unpublished evidence in Ecuador: a critical study on guarantees and access to justice

The admissibility of new evidence in Ecuadorian procedural law represents a delicate balance between safeguarding the right to litigation and preventing dilatory or abusive practices. This mechanism, regulated by the Organic General Code of Processes (COGEP), requires strict admissibility criteria to protect the fairness and efficiency of judicial proceedings. The inclusion of new evidence must respect principles of legality, adversarial process, and due process, ensuring no party is unfairly surprised. Furthermore, the regulation establishes precise deadlines and conditions to prevent new evidence from undermining legal certainty or unnecessarily prolonging the procedure. This critical analysis emphasizes the importance of a balanced application, enabling effective access to justice without compromising the integrity of the Ecuadorian judicial system.
