Fashion law in Ecuador

Abstract

This study analyzes Fashion Law as a legal discipline that addresses the regulation of fashion, including intellectual property, commercial contracts, and consumer protection. Cases such as Louis Vuitton vs. Tienda Moda Quito in Ecuador and other international cases are reviewed, applying research methods that allow for a more detailed analysis of the facts and an understanding of the regulations affecting the fashion market. The importance of protecting trademarks against counterfeiting is highlighted, with severe penalties and significant financial compensation. Fashion Law is assessed through aspects related to its influence on designers, manufacturers, retailers, and consumers, highlighting the need for clear and effective regulations. The research allowed for the analysis of violated legal principles such as trademark, design, and copyright rights, as well as the importance of protecting consumers from counterfeit products. Fashion Law plays an important role in the reputation of brands and consumer safety, protects intellectual property and promotes fair competition and highlights the need for robust legislation, with international cooperation in its implementation, to prevent actions that are harmful to companies and the population as the main consumer of fashion products.
