Scope and challenges of the prohibition to alienate movable property in ecuador’s precautionary system

The precautionary measure prohibiting the alienation of movable property, though intended to ensure the enforceability of judicial obligations, faces significant normative and operational challenges in Ecuador. Its application without clear legal standards undermines legal certainty and threatens the debtor's fundamental rights. Moreover, its classification as a precautionary measure must be evaluated under the principles of proportionality, reasonableness, and necessity outlined in the COGEP to prevent undue restrictions on economic fluidity and property transactions. The absence of specific regulation on this measure creates a legal vacuum that fosters inconsistent judicial interpretations and potential arbitrariness. Therefore, a legislative reform is urgently needed to establish its scope, conditions, limitations, and exceptions, thereby ensuring a balanced protection of creditors’ claims and debtors’ patrimonial rights.
